This study assesses the extent to which job application forms violate the New Zealand Human Rights Act. The sample for the study includes 229 job application forms, collected from a variety of large and small, public- and private-sector organizations that together employ approximately 200,000 workers. Two hundred and four or 88% of the job application forms contain at least one violation of the Act. One hundred and sixty five or 72% contain two or more and 140 or 61% contain three (...) or more violations. The most common violations concern age, gender, nationality, and disability. The least common concern political opinion, ethical belief, religious belief, and sexual orientation. Despite widespread violations, many forms do have non-discriminatory questions that yield the same kind of useful information as discriminatory questions. Employers could incorporate these into their job application forms to bring themselves into compliance with the law. The same lessons also generally apply to North American employers, given the high degree of comparability between American, Canadian, and New Zealand anti-discrimination laws. (shrink)

Matthews' little book tracks the course of Socrates' perplexity, which, Matthews contends, starts out (...) as an obstacle to successful inquiry, but becomes, eventually, itself the target of inquiry. Matthews regards as quite genuine the perplexity that Socrates professes in certain of the early dialogues—Laches, Charmides, Euthyphro—largely, however, because Matthews himself finds Socrates' questions so stubbornly persistent. Yet, couldn't Socrates, at least with respect to some of his questions, experience no state of confusion, no perplexity, but, nevertheless, profess perplexity? Perhaps Socrates' confessions of perplexity signal only his awareness that he lacks knowledge of virtue; perhaps they are but rhetorical devices for encouraging Socrates' interlocutors to admit to their own ignorance.As the book continues, Matthews, following a line fairly standard by now, thinks that, in the "transitional" Meno, Socrates discovers two ways out of the perplexity: recollection, and the method of hypothesis; and that, in the "middle" dialogues—the Republic and Phaedo—the Theory of Forms comes to his rescue. In the Parmenides and, perhaps later, Matthews maintains, the Theory of Forms becomes itself the object of inquiry, as Socrates recognizes the perplexities with which it is fraught. Matthews mentions, but takes no stand on, the controversies surrounding the late dialogues, moving on at last to Aristotle and the different kind of perplexity one encounters there.For the briefest moment it looks as if Matthews might resist the standard line, when, in discussing the Meno, he notices not only that the geometrical problem of the Meno's slave-boy passage causes no perplexity comparable to that caused by Socrates' philosophical problems, but that Socrates is fully in charge in the geometrical demonstration, stinging another without simultaneously stinging himself. Yet, not only does Matthews fail to pursue his insight that moral or philosophical questions are, for Socrates, not like mathematical ones; on the contrary, he suggests that, in the Phaedo, philosophical problems are viewed by Socrates as mathematical ones.In The Philosophy of Socrates, Brickhouse and Smith undertake the ambitious task of expounding and defending a coherent and cohesive Socratic philosophy, one that encompasses Socrates' method, his wisdom and ignorance, his understanding of the nature of knowledge, his moral philosophy, psychology, politics, and religion. The new book, although it purports to discuss the philosophy of the historical Socrates, is, from Chapter 2 on, a book about the Socrates of Plato's "early" dialogues. Yet, it is precisely this Socrates who is largely absent from its pages. The Socrates of the early dialogues is a character: both in the sense that he is a protagonist in the dramas that are Plato's dialogues, and in the sense that he is sarcastic, funny, makes bad puns, strikes at his interlocutors where they are most vulnerable, teases, baits, and annoys. But, most importantly, this Socrates is no solitary thinker. He talks to people; and what he says and how he says it is influenced both by his interlocutor and by the context of their conversation. In this book, one of the most distinguished scholars of German culture collects his essays on a figure who has long been one of his chief preoccupations. Erich Heller's lifelong study of modern European literature necessarily returns again and again to Friedrich Nietzsche. Nietzsche prided himself on having broken with all traditional ways of thinking and feeling, and once even claimed that he would someday be recognized for having ushered in a new millennium. While acknowledging Nietzsche's radicalism, Heller (...) also insists on the continuity of the story in which he does indeed occupy a central place. By considering Nietzsche in relation to Goethe, Rilke, Wittgenstein, Yeats, and others, Heller shows the philosopher's ambivalence toward the tradition he inherited as well as his profound effect on the thought and sensibility of those who followed him. It is hardly an exaggeration to say, as Heller does in his first essay, that Nietzsche is to many modern writers and thinkers--including Mann, Musil, Kafka, Freud, Heidegger, Jaspers, Gide, and Sartre--what St. Thomas Aquinas was to Dante: the categorical interpreter of a world, which they contemplate imaginatively and theoretically without ever much upsetting its Nietzschean structure. Thus it is Nietzsche's thought, so pervasively present in the themes of modernity, that gives coherence and unity to Heller's essays. What emerges from them is that, despite his iconoclastic declarations and unorthodox philosophical practices, Nietzsche deals with the human spirit's persistent concerns. His questions remain urgent, and even the answers, in all their contradictoriness, possess the commanding force of his inquiry. An example is the incompatibility of the famous extremes, the teaching of the U;bermensch and the Eternal Recurrence of All Things. These cancel each other out and yet grow from the same intellectual and spiritual roots, as is shown lucidly and cogently by one of Heller's most forceful essays, "Nietzsche's Terrors: Time and the Inarticulate." In fathoming the depth of this contradiction, Heller at the same time reveals the importance of Nietzsche for those who seek to understand the wellsprings of the epoch's disquiet, turmoil, and creativity. Anti-essentialism holds that no thing has any modal properties except relative to a conceptualization—for instance, relative to a description. One and the same thing might be essentially rational relative to the description “mathematician” but only accidentally rational relative to the description “bicyclist.” Anti-essentialism was dominant in pre-Kripkean days. The old description theory of names made room for anti-essentialism by reducing apparently true de re modal attributions to de dicto ones by way of the hidden description. We can follow Kripke in (...) giving up the description theory without thereby giving up anti-essentialism. Counterpart theory makes room for anti-essentialism by interpreting de re modal attributions by way of counterparts and allowing that different other-worldly objects count as a thing’s counterparts relative to different ways of thinking of the thing. One thing is essentially physical when thought of as a body but only accidentally physical when thought of as a person. One thing has its shape essentially when thought of as a statue but only accidentally when thought of as a lump of clay. The metaphysical meat of counterpart theory is that it allows for anti-essentialism. (shrink)

Wilkins & Wakefield suggest that changes in the hominid brain made it uniquely “preadaptive” for language, yet no precursor functions served as adaptive substrates to the emergence of language. We present contrary evidence that the ability to discriminate and process rapid and complex auditory information is a cross-species function subserving communication processes including, but not limited to, human speech perception. We suggest that auditory temporal processing served as an evolutionary precursor to speech processing and consequent language development in humans.

Historically, studies of the role of endogenous hormones in developmental differentiation of the sexes have suggested that mammalian sexual differentiation is mediated primarily by testicular androgens, and that exposure to androgens in early life leads to a male brain as defined by neuroanatomy and behavior. The female brain has been assumed to develop via a hormonal default mechanism, in the absence of androgen or other hormones. Ovarian hormones have significant effects on the development of a sexually dimorphic cortical structure, the (...) corpus callosum, which is larger in male than in female rats. In the females, removal of the ovaries as late as Day 16 increases the cross-sectional area of the adult corpus callosum. Treatment with low-dose estradiol starting on Day 25 inhibits this effect. Female callosa are also enlarged by a combination of daily postnatal handling and exogenous testosterone administered prior to Day 8. The effects of androgen treatment are expressed early in development, with males and testosterone-treated females having larger callosa than control females as early as Day 30. The effects of ovariectomy do not appear until after Day 55. These findings are more consistent with other evidence of a later sensitive period for ovarian feminization as compared to androgenic masculinization. (shrink)

A number of commentators agree that the evidence reviewed in the target article supports a previously unrecognized role for ovarian hormones in feminization of the brain. Others question this view, suggesting that the traditional model of sexual differentiation already accounts for ovarian influence. This position is supported by various reinterpretations of the data presented (e.g., ovarian effects are secondary to the presence/absence of androgen, ovarian effects are smaller than testicular effects, ovarian effects are not organizational). We discuss these issues, and (...) reiterate our position that evidence of neurobehavioral ovarian effects is incompatible with the currently accepted model of sexual differentiation. Other points regarding species generalizations, the direct versus indirect action of estrogen, and nonhormonal mechanisms of sexual differentiation are also discussed. Finally, we address the controversial issue of using ratio scores in the assessment of the human corpus callosum (where CC scores are divided by an index of brain size). Based on excellent secondary sources, this history presents an overview of music education from Colonial America, through the development of textbooks in the nineteenth century and the growth of professional organizations in the early twentieth century, to the expansion of the curriculum and the role of government in education since 1950.This third edition is written by Michael L. Mark, professor emeritus at Towson University in Maryland, and dedicated to the memory of his friend and coauthor, Charles L. Gary.1 Mark has written two other books that complement the history editions. Contemporary Music Education surveys various reform projects since the 1950s, trends in the philosophy of music education, government policies, and the development of new methods.2Music Education: Source Readings includes writings about music education from both the European and American perspectives.3 There are many recent articles and dissertations on the history of music education, but the only recent book is Terese Volk's Music, Education, and Multiculturalism, which describes school programs and materials emphasizing multiculturalism in the twentieth century from a historical perspective.4 Publications in musicology add to our knowledge of the history of music in American society, but musicologists rarely write about music in public schools. Publications on the history of education are helpful in understanding trends in music education, but these publications do not discuss music.The third edition of A History of American Music Education is expanded to 500 pages from the approximately 400 pages of the earlier editions, largely because of new formatting and [End Page 115] spacing that make the third edition easier to read. Each chapter has a reference list in APA style in contrast to the Chicago Manual style of the earlier editions, with endnotes plus a bibliography at the end of each chapter. The material in Mark's third edition is basically the same as the earlier editions, with some expansion of the history of music education after 1950.This book, based on secondary sources, is an overview of the history of music in American public schools, showing the response of education to societal needs during various historical periods. There is an emphasis on the role of national music organizations, especially MENC: The National Association for Music Education (MENC), in advocating for the importance of music for every child. The historical account includes the various justifications for teaching music and discussions of the meaning of music. There were times when music educators were interested in aesthetics, but there were also many times when they were mainly interested in a practical understanding of music and extrinsic motives for including music in the school curriculum.5The first section on "The Western Heritage" (chapters 1-3) briefly covers music in Jewish traditions through the Greek and Roman cultures because the insights of these ancient thinkers influenced all Western societies. The chapter on the Middle Ages through the Reformation shows the role of music as a practical subject, part of the quadrivium with arithmetic, geometry, and astronomy. As music became an integral part of the church, musicians developed methods of teaching note reading. Martin Luther promoted the singing of "good music" in schools and education in the vernacular for the middle classes. With the development of Italian conservatories and the patronage of music by the elite classes of the Renaissance, music training became specialized for musicians working in the church and courts. These various conflicting European opinions of the role of music in society influenced American education.The second section on "The New World" (chapters 4-5) emphasizes the use of music as a means of praising God. Women music educators in the USA have been active in public and private schools, churches, and community organizations. In the nineteenth century, Julia E. Crane founded the Crane Institute of Music, the first institution to train music supervisors; and women developed kindergarten programs throughout the US. In the "private sphere," women taught in home studios and Sunday schools, and published children's songs and hymns. In 1907, the Music Supervisors National Conference (which became the Music Educators National Conference) was founded under (...) the leadership of Frances E. Clark, although only thirteen women have been president of MENC between 1907 and 2010. In the twentieth century, women have edited music textbook series and served on editorial boards of music education journals. This survey of nationally prominent music educators shows the importance of quality education, guiding personal philosophies, positive supportive mentors, and leadership opportunities within the profession for developing successful lifetime careers. Street art has exploded: it pervades our back alleys, surrounds us at bus-stops, covers billboards, competes with advertising and generally serves as urban wallpaper in most cities. But what is street art? A far cry from mere graffiti, street art has gained some social acceptance, but it remains neither officially sanctioned like public art, nor institutionally condoned, like its more traditional artistic cousins in museums. Somewhere in between these two extremes, street art has emerged, occupying a metaphysically suspect grey area (...) between illegal activity and bona fide art. This paper explores the nature of this emerging art form and draws out some of the differences between street art, public art and ‘mere’ graffiti. (shrink)

I argue that activists have co-opted street art as a tool for addressing epistemic injustices, injustices that result from negative identity prejudices that silence certain groups of people unfairly. To defend this claim, I explore the special nature of street art that makes it an especially appropriate tool for activists to enlist in the fight against epistemic injustices. From there, I will examine in detail two case studies which illustrate how street art is used to respond to and correct for (...) these injustices: first, the street art series, “Stop Telling Women to Smile” by Tatyana Fazlalizadeh, and then Chris Metzger’s Inside Out Project in Baltimore. Drawing on these examples, I highlight the features in virtue of which street art constitutes a particularly effective tool for correcting epistemic injustices. (shrink)

In this article, I explore the relationship between witness-bearing arts as a form of creative activism designed to respond to social injustices. In the first section, I present some common features of bearing witness, as conceptualized within media studies and journalism. Then I explain how artworks placed in the streets can bear witness in a similar way. I argue that witness-bearing art transmits knowledge about certain unjust and harmful events, which then places a moral burden or responsibility on the viewer. (...) To defend this view, I offer some examples of activist art that bears witness to certain events. I suggest that witness-bearing art is placed in the streets in order to make certain truths publicly available, by offering evidence of them embedded in the artwork. The final section considers why the bearing witness is especially effective for activist art. Witness-bearing art plays a crucial knowledge-transmitting function, one which enables art to engage in creative activism. I conclude by considering how witness-bearing art offers a powerful and persuasive voice for the oppressed. (shrink)

The re­searchers will work together on the construction of a unified formal ontology, which means: a general framework for the construction of ontological theories in specific domains. The framework will be constructed using the axiomatic-deductive method of modern (...) formal ontology. It will be tested via a series of applications relating to on-going work in Leipzig on medical taxonomies and data dictionaries in the context of clinical trials.
